Lakeside shooter Joseph Patrick Lamoureux appeared before Judge John Davis Tuesday, and pleaded not guilty be reason of insanity to all 15 charges levied against him. His trial is set for 10 a.m., March 29-April 2, 2010, and will be continued from April 6-7. Lamoureux faces multiple charges of attempted murder, battery upon an officer with use of a deadly weapon, assault with a deadly weapon on an officer, discharging a firearm into a structure and more. Lamoureux is a former Army Reserve sergeant who went on a shooting spree Sept. 19, 2008, at Terrible's Lakeside RV park. Dep. Eric Murphy was shot during the gun battle with Nye County sheriffs deputies in the early hours of the morning. Lamoureux was captured after he was shot in the legs. The defendant, who is now being represented by the local firm of Gibson & Kuehn, appeared with attorney Mickey Sherman, a well-known East Coast defense lawyer, who told Davis, "We have at least five expert witnesses. They are going to meet with our client and talk to our client and test him." It is believed Lamoureux's legal team will mount a defense based on post-traumatic stress disorder. Bianca Razo-Pina Bianca Razo-Pina, the 18-year-old mother charged with murdering her 2-1/2-month-old daughter, appeared before Judge John Davis Tuesday for arraignment. She pleaded not guilty to charges of murder as well as child abuse. Her attorney, Harry Kuehn, told the court their expert witness was not available until February. Her trial was set for March 15-18, 2010. Branden O'Conner Judge John Davis squashed requests to combine the seven cases against Branden Scott O'Conner on Tuesday, saying "We are going to have seven different trials." O'Conner is accused of the Aug. 19, 2008, murder of Jeremy Frye. The defense filed 28 discovery requests with the district attorney's office, which will be honored before the next hearing date is set. Petell trial set Jim Petell appeared briefly in district court Tuesday, with his attorney Carl Joerger for a status check on his 2007 felony charge. He is accused of attempting to defraud the Saddle West Casino. A trial date was set for March 25-26, 2010. Drug bust A traffic stop by Nye County Sheriff's Office lead to the arrest of three Pahrump residents on drug charges. Estabon Rojo-Flores, 30, is being held on $50,000 bail on four charges. Raul Garcia-Rojo, 28, is being held on $50,000 bail for nine charges. His girlfriend is being held in Tonopah on $30,000 bail for high-level methamphetamine trafficking and possessing under one ounce of marijuana. She also had a Carisoprodol pill without a prescription in her purse. Carisoprodol is a muscle relaxer that works by blocking pain sensations. On Sept. 9, at 12:51 p.m., patrol deputies working with members of the Scorpion Narcotics Task Force stopped a cream colored Chrysler owned and driven by Garcia-Rojo. A press release from the sheriff's office said the task force is aware Garcia-Rojo was involved in the illegal sales of methamphetamine. Rojo-Flores was the passenger in the vehicle when it was pulled over and searched after the task force was granted a search warrant. One pound of marijuana and 112 grams of methamphetamine was found in the Chrysler. A search warrant was also granted for Garcia-Rojo's residence, and during a search approximately 40 grams of methamphetamine and about 10 grams of marijuana were found. While the deputies and task force were at the residence, Garcia-Rojo's 21-year-old girlfriend arrived. According to the press release, she is believed to be involved in the illegal sales of narcotics. She said she came over to check on Garcia-Rojo's parents, who were present when the search warrant was served. She also gave Garcia-Rojo's address as her residence and therefore is assumed to have partial ownership of all items inside of the home. Drugs were found in her purse and she was also arrested. In a phone call to the Pahrump Valley Times, the woman's grandmother said her granddaughter was immature, acting more like a teenager of 15 than a 21-year-old woman. She also said her granddaughter had never been arrested before, was scared and was not told how to contact a lawyer. Child abuse/neglect Cassidy Roberts-Peterson, 28, of Pahrump, was arrested Saturday about 11 p.m., for child abuse and/or neglect. Bail was set at $5,000. Nye County Sheriff's Dep. Mike McGrath was dispatched to Roberts-Peterson's home to investigate a petty theft. When he arrived, Roberts appeared to be intoxicated. According to a press release from the sheriff's office, her speech was slurred; she had an unsteady gait and depressed motor skills. Roberts-Peterson was alone in the home while caring for her 1-year-old child. She admitted to having consumed a "bottle of vodka" in about an hour. She also told McGrath she was taking prescribed anti-depressant medication at the same time. McGrath conducted a preliminary breath test and found Roberts-Petersen had a blood-alcohol concentration of 0.141 percent. Since she was the sole caregiver for the child, the 1-year-old was taken into protective custody and Roberts was arrested and transported to the Nye County Detention Center, where she was booked. The child was ultimately placed with her grandfather. |
