On Wednesday, Town Manager Bill Kohbarger filed a report with the Nye County Sheriff's Office regarding Don Cox's behavior after the April 28 town board meeting.

According to Kohbarger, Cox acted aggressively, repeatedly yelling, "I'll take you out."

There were three witness statements accompanying Kohbarger's report, detailing what they saw or heard that night.

Deputies will have to investigate Kohbarger's remarks, after which the district attorney could choose to file charges.

"Don Cox approached me in a very threatening manner," said Kohbarger. "He was about 25 feet away from me and then charged to within four to eight inches of my face. He wanted to fight. I kept my cool the best I could, but I thought he was going to hit me."

That was the second time Cox approached Kohbarger as the town manager left the meeting that night. When Kohbarger exited the community center the first time to stow his meeting materials in his vehicle, Cox was among five or more men who surrounded Kohbarger, yelling at him.

Kohbarger said he thought about Cox's actions for several days before calling town board members. "I pretty much got consensus that I couldn't let the behavior pass because it's been escalating.

"I have to think about the safety of everybody. I have to consider the safety of my staff and the safety of the board members and the residents who attend the town meetings. I have to do what I have to do."

Reportedly, Cox also approached board member Frank Maurizio as he left the meeting, but the ex-policeman didn't respond to Cox's alleged baiting. Board member Mike Darby was not at the meeting due to a death that day in his family, but the remaining three board members took different exits from the building to avoid any confrontation.

Sheriff's deputies were called to the scene and scattered the crowd in front of the Bob Ruud Community Center.
