Judge denies defense request to delay Liakopoulos trial

Fifth District Judge Robert Lane rejected a request to delay the jury trial of former Nye County Commissioner Peter Liakopoulos until the fall and a motion to toss out a misdemeanor charge.

The trial is scheduled to begin as planned at 9 a.m. June 29.

Liakopoulos was indicted on two felony counts of asking or receiving a bribe, a misdemeanor count of offering a reward for an appointment and another misdemeanor count of grafting by a public officer.

The Nevada Attorney General's office complaint charges Liakopoulos with agreeing to vote in favor of a half-cent county sales tax in exchange for the Pahrump Town Board appointing his wife, Jenny, as the curator of a planned veterans memorial.

The offer was made to former Pahrump Town Board Member Laurayne Murray, directly, and through former Town Manager Dave Richards, the complaint charges. Jenny Liakopoulos didn't get the appointment and Liakopoulos didn't vote for the sales tax hike, which failed to pass the county commission in December 2007.

Public defender Tom Gibson wanted more time for the trail, claiming there was possible misconduct in the investigation by the Nye County Sheriff's Office. He wanted more time to subpoena records for impeachment and credibility issues.

Lane sided with the attorney general's office that Gibson failed to show good cause to continue the case and explain why information being sought could not have been obtained in the one year since the complaint was filed.

"The bare allegation of possible misconduct that may have occurred could be asserted by any defendant in any criminal trial. While the inclusion of supporting evidence may have provided adequate grounds for continuing the trial the current motion does not," Lane wrote.

The defense also wanted Lane to throw out a charge of offering a reward for an appointment. Gibson said the state didn't present proof the curator job was an extension of the Pahrump Town Board.

The curator was to have been appointed by a veterans memorial advisory board.

Lane wrote there isn't a requirement for the state to show the town board created an advisory board, that the museum curator position came into existence or the Pahrump Veterans Memorial Museum.

Liakopoulos was elected in November 2006 but resigned his position two years later. Gov. Jim Gibbons appointed Fely Quitevis to serve out the remainder of his term until January 2011.
