Contractor's license jerked for three unfinished homes

The contractor's license of Desert Breeze by Integrity Inc., a Pahrump company, was revoked and the company fined $14,550 plus restitution costs by the state contractor's board last week for substandard workmanship, failing to take corrective action and other violations. Investigative fees total $4,092 in the case. The restitution is to be paid into the Residential Recovery Fund set up by the state contractor's board. Desert Breeze by Integrity Inc., with an address of 3170 Winery Road, was issued a contractor's license on Aug. 21, 2006, with Felicia Ortega president and Donald Welch Durham the secretary-treasurer. Desert Breeze by Integrity didn't respond to a notice of a complaint and a hearing before the contractor's board March 24. The 23 page complaint lists eight parties who were cheated by the company. * Hartmut Yago entered into a $259,117 contract April 8, 2006 with Desert Breeze by Integrity and Bangle Enterprises Inc. for construction of a single family home at 2481 S. Washoe St. Desert Breeze by Integrity was on the project from April 2006 to September 2006. The company failed to install a water and septic system, a residential alarm, reverse osmosis system and entrance gates. * Sheri Anne Hess, entered into a $200,000 contract on March 14, 2007 to build a home at 212 E. Cactus St. Inspectors found 37 discrepancies. Contractors didn't install glass doors to the fireplace, a Jacuzzi tub, cabinet doors, tile for the tub, bathtub fixtures, a water closet, a hot water heater, closet doors, a sink, mirrors in the bathrooms, electrical power, water and carpeting. * Richard Prader entered into a $242,320 contract to build a home at 6251 N. Fitzroy Ave. on June 26, 2007. Work began Aug. 2, 2007 and lasted until Jan. 31, 2008. Investigators noted 33 discrepancies. Stucco surrounding decorative lights wasn't repaired. Cabinet doors above the oven didn't close; caulking surrounding the tub in the master bathroom was delaminating and tool marks were visible in the drywall of the dining room. Contractors didn't install a pantry door in the kitchen, a sink in the laundry room, mirrors throughout the residence and closet doors to two bedrooms. * Nathan and Samantha Messer signed a $305,000 contract in June 17, 2007 to build a home at 1171 E. Heritage Dr. Work began on July 13, 2007 and lasted until Jan. 31, 2008. Investigators found 108 violations. An intercom and alarm system wasn't installed. Contractors didn't install plumbing for sinks and a jacuzzi as well as cabinet drawer faces and doors in the master bathroom. A fiberglass shower enclosure was cracked. Window frames in the master bedroom weren't caulked while there was excessive caulking on the window frame of the dining room. Many windows had excess paint. Door weather stripping can't be installed on the garage due to improper placement of stucco. Closet doors weren't installed at numerous locations. Tile work, sink and plumbing work weren't completed in one bathroom. The heating and air-conditioning system is non-operational. Carpeting hasn't been installed in the hallway. * Pahrump Valley Doors complained Desert Breeze by Integrity Inc. never paid $5,760 for doors purchased for the Messer project on Aug. 3, 2006. * Junior's Windows claimed they weren't paid $3,941 for windows for the Prader home ordered on Aug. 14, 2007 and $3,508 for windows at the Messer home a week later. * Floors 4 Less filed a complaint they weren't paid $1,107 for carpeting at the Prader home on Dec. 18, 2007. * Engle Technical Services reported they weren't paid an $8,715 balance for a surround system/alarm system and closed-circuit TV system at the Prader residence and $14,668 for the Messer residence. * Pahrump Valley Granite said they weren't paid $13,817 for materials purchased for the Messer home Nov. 7, 2007 and a $1,500 balance for materials purchased on Oct. 22, 2007 for the Prader home. Desert Breeze by Integrity Inc. isn't listed in the Pahrump phone book. Phone numbers listed for company president Felicia Ortega at 3170 Winery Road and 3791 S. Vanguard Avenue have been disconnected or are no longer in service. Art Nadler, a spokesman for the state contractor's board, said since Desert Breeze by Integrity Inc. was a licensed contractor, the three homeowners affected will be eligible to apply for up to $35,000 per home in the Residential Recovery Fund if the company doesn't pay the restitution. The fund is paid for by a portion of the license fees paid by contractors. There is a limit of $400,000 that will be paid out of the Residential Recovery Fund for any contractor, Nadler said. |
