Kulkin residency complaint is filed

A challenge to the candidacy of Harley Kulkin as a legal resident of Nye County Commission District 3 race has been filed by Mark Reasbeck, who produced extensive video tapes as evidence.

Kulkin formerly ran unsuccessfully for Nye County Commissioner of District 1 in the 2004 election, losing to incumbent Roberta "Midge" Carver. That district includes much of eastern Pahrump.

He said he is now renting space at the Tough Boy RV Park, 2530 Tough Boy St. in Pahrump, where he has an Eagle Coach parked, which he said is a converted Trailways bus.

The complaint states Kulkin filed a voter registration change of address April 8, from his former address at 8825 N. Linda St. to 2530 Tough Boy St.

The complaint charges Kulkin, in his declaration of candidacy, stated he "actually as opposed to constructively" resided at 2530 Tough Boy Road and that he lived there at least 30 days before the close of the filing period for the election, May 16.

The complaint states, "From April 11, 2008, through April 18, 2008, recreational vehicle space five was continuously vacant with no vehicle, recreational or otherwise being present.

"During said time frame there was no facility available for Mr. Kulkin to reside in as said address was nothing more than a trailer space and adjacent parking space."

The complaint charges attempts were made to contact Kulkin in a Ford Econoline Harvest camper van, which was parked in the RV space April 19, to no avail. The windows were covered up with cardboard and sealed with duct tape. That vehicle was replaced with another RV vehicle May 29, the complaint states.

The complaint continues: "Said efforts to locate Mr. Kulkin at said address have been futile in that Mr. Kulkin has not been present at said address, nor has any activity been observed or any sounds been detected from camper van."

A video record of the RV park space shows Kulkin was only physically present there less than 10 hours from May 2 to May 30, the complaint alleges.

Nye County Clerk Sam Merlino said the complaint was given to the county district attorney's office and the Nevada secretary of state's office.

The district attorney's office determined Thursday there's probable cause to schedule an evidentiary hearing in district court during which Kulkin will have to appear.

"Luckily this challenge does not affect the primary. He filed as a Democrat so he goes straight to the general," Merlino said.

Videos of Kulkin's television show "Eye on Nye" were submitted in which Kulkin stated his intention to rent an RV space at the Tough Boy RV Park and run for District 3 commissioner.

The complaint states: "Mr. Kulkin's recently claimed residence in a recreational vehicle located in a recreational vehicle park is nothing more than a sham to get around our laws that require a county commission candidate actually live in the district that he seeks to represent."

Reasback said as a resident of District 3, he wants to know his county commissioner is a real resident of the district. He said allowing Kulkin to falsely claim he resides in the district will allow anyone to do the same thing in the future.

Reasback's name has been mentioned both this year and in 2004 as a possible candidate for Nye County commissioner of District 3.

Kulkin said his residence was all legal and that he has three months' worth of rental receipts to prove it. He said the home is a 40-foot recreational vehicle with a washer, dryer, an LCD-screen television, microwave and hot water heater.

"I never signed a statement saying this was my primary residence. I signed a statement it was my actual residence as opposed to a constructive residence. A constructive residence means I'm using someone else's address," Kulkin said.

Clark County Commissioner Lynette Boggs McDonald was cited with charges of perjury for stating she was a legal resident while living outside her district in Las Vegas. Kulkin said she was accused of using her maid's home as a residence, but videotaped taking out the garbage in her home outside her district.

Kulkin said the complaint filed against him is an attempt by supporters of incumbent District 3 Commissioner Gary Hollis to avoid likely defeat in November.

"I've heard from many people that he is extremely concerned about losing to me and he is going to try to do whatever he can to discredit me, do what he can to get in," Kulkin said.

Kulkin said Nye County is very corrupt, including the way county commission districts were drawn that unfairly discriminate against Pahrump, with over 80 percent of the county's population.

Kulkin said he hasn't finished restoring his other home in Johnnie since a fire there in December 2006.

"I'm here every single day. Sometimes I sleep here, sometimes I don't," Kulkin said of his RV park residence. "If the voters don't like the fact I have a second residence and it's a converted bus, don't vote for me."
