Tuck pleads not guilty; attorney seeks quick trial

As expected, Darrin Tuck Jr., the Pahrump resident who turned over the videotape of a 3-year-old girl getting sexually assaulted, pleaded not guilty to one charge of possession of child pornography in Fifth District Court on Monday.

The video led to a nationwide manhunt for the victim, now 7-years-old, who was found safe and living with her mother in Las Vegas, as well as the arrest of the alleged perpetrator of the assault, Chester Stiles.

Christopher Rasmussen, Tuck's defense attorney, said he wanted to go to trial for the charge as quickly as possible and he expected it to be a two-day trial.

The defense attorney also asked the court if a preliminary questionnaire could be sent to prospective jurors prior to the jury selection process to help ensure an unbiased panel.

"I think it's going to be difficult in this community, especially because it's so small, to find jurors that haven't heard about this case," Rasmussen said.

He indicated that it might ultimately be necessary to move the trial to another venue entirely.

Judge Robert Lane asked that Rasmussen submit a draft of the proposed questionnaire to the state and see if both sides could agree to it.

In addition, Rasmussen reminded Lane that he had expressed the possibility of recusing himself from the trial because drug court administrators had told him that Tuck was asking about turning in the tape prior to his arrest.

Lane said he would review the transcripts of the prior hearing and issue a written decision in about two days.

He also told Rasmussen that he and Judge John P. Davis, in Tonopah, had full calendars for the next five or six months, but that every effort would be made to see that Tuck had his trial as soon as possible.

A calendar call is scheduled for January 7.

Tuck is currently in custody at the Nye County Detention center serving a five-month sentence for violating his probation by not paying child support.
