Derr pleads not guilty as trial set

William Earl Derr, 40, pleaded not guilty to a number of charges involving kidnapping and sexual assault in Pahrump Fifth District Court on Tuesday. He is scheduled to stand trial in Tonopah March 17. Derr is facing the charges for his alleged involvement in two sexual assaults that occurred three days apart in March. The first incident occurred March 7 at the VFW on Homestead Road. The victim was found the following morning in front of the building with her hands and ankles zip-tied. For that assault, Derr is facing one count of sexual assault and one count of first-degree kidnapping. The second incident for which Derr will be tried involves a woman who was Derr's neighbor and alleges he held a knife to her throat and sexually assaulted her in her home. For that incident, Derr is charged with one count of sexual assault, one count of first-degree kidnapping, battery with intent to commit a crime, assault with a deadly weapon, and three counts of unlawful use of a controlled substance. Bob Glennen, Derr's defense attorney, said he will file a writ of habeas corpus on his client's behalf. Derr was recently convicted for a misdemeanor charge of battery and sentenced to five months of incarceration for an incident that occurred at the Valley Bar April 1. Derr is housed at the Nye County Detention Center on $250,000 after a request by Glennen to reduce his bail at the preliminary hearing resulted in Justice of the Peace Tina Brisebill raising it, instead, from $100,000. |
