Garcia agrees to testify

Victoria Garcia is scheduled for arraignment in Fifth District Court at 9 a.m., Oct. 23, after she conditionally waived her right to a preliminary hearing in Pahrump Justice Court Thursday.

Nye County Chief Prosecutor Kirk Vitto served Garcia with a subpoena to testify at the Oct. 15 Justice Court preliminary hearing of Rodriguez, who is being charged with attempted murder of a sheriff's deputy with use of a deadly weapon; battery on a peace officer with use of a deadly weapon, and assault with a deadly weapon.

She has been charged as an accessory to a crime and two counts of unlawful use of a controlled substance and is currently being held on $60,000 bail, the amount that was set by Justice of the Peace Tina Brisebell, Sept. 7.

Garcia was one of three passengers in a vehicle that was pulled over by Nye County Sheriff's Dep. Harry Williams for fictitious plates the evening of Aug. 27. The driver of the vehicle, Jesus Rodriguez, allegedly entered into a firefight with Deputy Williams and shot him in the left leg. The suspects then fled the scene.

Garcia and one of the other passengers, Shawna Irene Millar, 24, were in the vehicle with Rodriguez when the firefight took place and also fled the scene after the shooting. Approximately a week after the incident, however, they wrote a letter to local television stations explaining their actions and turned themselves into authorities. They were later charged.

Rodriguez was apprehended by authorities in Mecca, Calif., Sept. 15, by officers of the NCSO with the assistance of the U.S. Marshal's Service.

He is being held on $100,000 cash or $1 million surety bond.

Millar unconditionally waived her right to a preliminary hearing in Pahrump Justice Court Thursday, Sept. 22. She agreed to plead guilty to charges of obstruction of a police officer and unlawful possession of a controlled substance.

She also agreed to testify truthfully about the episode when called upon to do so as part of her negotiation with the state.

Millar's arraignment is scheduled for October 9 at 9 a.m.
