Another handgun mishap

Victim threatened by his own gun

An early Saturday morning -- or late Friday night, depending on how you want to view it -- house party taking place last weekend on Pahrump's Falcon Street between Gamebird Road and Dandelion Street, quickly turned sinister, yet could have taken a different turn and wound up deadly but for the intervention of other party-goers.

The 19-year-old victim allegedly brought the trouble on himself by packing a handgun, a silver semi-automatic 9mm Ruger, which he wore concealed to the party.

That was Glen Westfall's first mistake.

Westfall, according to the sheriff's office press release, was at the house party when, around 3:30 a.m., another party-goer, Clinton Brooks, 20, saw Westfall's gun stuck in his pants. Brooks reached out and took the Ruger from Westfall's waistband, pointing it at him.

Westfall later explained to officers that he had brought the gun along "for protection from people who go to those parties."

But now Westfall was defenseless; Brooks had all the power. Brooks allegedly ordered Westfall to get on the ground, or he would kill him, according to the sheriff's office release and several eyewitnesses. Westfall did as he was told, and Brooks then backed off.

Moments later, however, Brooks returned and demanded that Westfall get back down on the ground. This time Westfall didn't comply fast enough and Brooks grabbed him by the arm and attempted to strike him with the gun.

Westfall blocked the blow with his free, left forearm, but Brooks again tried to strike him on the left side of his face.

Several people at the party by then saw the fight erupting in their midst and came to assist Westfall by disarming Brooks. Westfall then fled the scene.

When the Nye County Sheriff's Office was notified of the incident around 7 a.m. Saturday, deputies T. Healing and D. Mckillups were dispatched to Westfall's nearby residence where Westfall told his story but said he didn't know what had happened to the gun, according to the sheriff's office press release.

The Ruger, it was later learned, was actually in Westfall's possession in his bedroom, again according to the press release. He apparently had retrieved it after being saved from further humiliation by Brooks.

Healing then got Brooks' address from the dispatcher and proceeded to his residence at 2021 Nevada West St., in the Calvada subdivision off Highway 160, again, not far from where the party had been.

Of two males asleep in the living room, one was Brooks.

Brooks was read his rights and taken to the Pahrump detention facility and booked on charges of battery with a deadly weapon, carrying a concealed weapon and, as an ex-felon, for being in possession of a firearm.

Deputy Healing then returned to the Westfall residence to continue with some questioning about the still missing gun.

Westfall gave the deputy the name and phone number of the individual who had held the late-night house party. Healing contacted the residence and met with the individual Westfall named.

The unidentified individual told Healing he saw Brooks talking to Westfall while holding the gun on him. He also named two other witnesses to the incident. They were contacted, one of the two telling the police he had assisted in disarming Brooks, had emptied the round from the chamber and taken out the magazine.

He said he had then placed the gun under the covers of another witness' bed in his bedroom.

The first witness gave police the bullets from the magazine. It was at that point that Healing went back to the victim's residence.

The deputy confronted Westfall with evidence that the gun belonged to him, which Westfall then admitted. It was then that he told Healing about taking the gun to the party.

When he showed Healing where the gun was stored, the deputy took custody of it and placed Westfall under arrest.

He was booked at the same detention center as his persecutor, Brooks, and charged with obstructing a peace officer in his investigation and carrying a concealed weapon. Bail was set at $1,632.
